      "body": "中共中央政治局常务委员会召开会议 听取关于吉林长春长生公司问题疫苗案件调查及有关问责情况的汇报\n\n人民日报客户端8月17日报道，8月16日晚，一则题为《政治局常委会听取关于长春长生问题疫苗案件调查及有关问责情况汇报》的消息引起了社会各界广泛关注——\n\n“会议同意，对金育辉（吉林省副省长，2017年4月起分管吉林省食品药品监管工作）予以免职，对李晋修（吉林省政协副主席，2015年12月-2017年4月任分管吉林省食品药品监管工作的副省长）责令辞职，要求刘长龙（长春市市长，2016年9月任长春市代市长，2016年10月至今任长春市市长）、毕井泉（市场监管总局党组书记、副局长，2015年2月-2018年3月任原食品药品监管总局局长）引咎辞职，要求姜治莹（吉林省委常委、延边朝鲜族自治州委书记，2012年3月-2016年5月任长春市委副书记、市长）、焦红（国家药监局局长）作出深刻检查；对35名非中管干部进行问责；决定中央纪委国家监委对吴浈（原食品药品监管总局副局长、原卫生计生委副主任，分管药化注册管理、药化监管和审核检验等工作）进行立案审查调查。会议责成吉林省委和省政府、国家药监局向中共中央、国务院作出深刻检查。”\n\n\n很多人看了这则消息后会发现，通报中一共涉及了7名省部级干部，分别为金育辉、李晋修、刘长龙、毕井泉、姜治莹、焦红、吴浈，但对他们的处理方式是不一样的：对金育辉予以免职，对李晋修责令辞职，要求刘长龙、毕井泉引咎辞职，要求姜治莹、焦红作出深刻检查，对吴浈则是被立案审查调查。从认定所犯错误的严重程度来看，被立案审查调查显然是处理得最重的，中央纪委国家监委网站已发布消息，称吴浈涉嫌严重违纪违法，目前正接受中央纪委国家监委纪律审查和监察调查；深刻检查则是其中处理得最轻的，当事人职务并不会发生变化。\n\n那么，问题来了，免职、责令辞职、引咎辞职，看起来表述不一样，但这四个人都显然不再担任现任领导职务了，那么这三者之间有什么区别呢？\n\n经专业人士指点，记者在2014年1月中共中央印发的《党政领导干部选拔任用工作条例》、2009年中办国办印发的《关于实行党政领导干部问责的暂行规定》和2004年中央颁布的《党政领导干部辞职暂行规定》中找到了答案。\n\n其中《关于实行党政领导干部问责的暂行规定》第七条规定：“对党政领导干部实行问责的方式分为：责令公开道歉、停职检查、引咎辞职、责令辞职、免职。”从这一排列顺序可以看出，从问责的严厉程度而言，免职重于责令辞职，责令辞职重于引咎辞职。\n\n《党政领导干部选拔任用工作条例》第五十七条规定：“党政领导干部有下列情形之一的，一般应当免去现职:(一)达到任职年龄界限或者退休年龄界限的。(二)受到责任追究应当免职的。(三)辞职或者调出的。(四)非组织选派，离职学习期限超过一年的。(五)因工作需要或者其他原因，应当免去现职的。”金育辉显然属于第二种情形。\n\n《党政领导干部辞职暂行规定》则对引咎辞职和责令辞职进行了详细的阐述。根据该规定，党政领导干部辞职包括因公辞职、自愿辞职、引咎辞职和责令辞职。其中第十四条规定，“党政领导干部因工作严重失误、失职造成重大损失或者恶劣影响，或者对重大事故负有重要领导责不宜再担任现职，本人应当引咎辞去现任领导职务。”并在第十五条中具体列举了应当引咎辞职的九种情形。第十九条则规定，“党委(党组)及其组织(人事)部门根据党政领导干部任职期间的表现，认定其已不再适合担任现职，可以通过一定程序责令其辞去现任领导职务。党政领导干部有本规定第十五条所列情形之一，应当引咎辞职而不提出辞职申请的，党委(党组)应当责令其辞职。”\n\n也就是说，免职就是上级组织直接解除领导职务，如同炒鱿鱼；责令辞职就是任免机关认定其已不再适合担任现职，通过一定程序责令其辞去现任领导职务；引咎辞职则是主动辞去领导职务、自我追究过失责任的一种形式，但如果要求其引咎辞职却不答应的话，也一样可以责令其辞职。用形象一点的说法，三者分别类似强制下岗、通知下岗和劝其主动下岗。其中，前两者为被动接受组织处理，而引咎辞职则是督促其主动承担责任的行为。\n\n那么，有人要问了，不都是不再担任领导职务了吗，对这些人的影响是否相同呢？《党政领导干部选拔任用工作条例》第五十九条作出的规定是：“引咎辞职、责令辞职和因问责被免职的党政领导干部，一年内不安排职务，两年内不得担任高于原任职务层次的职务。同时受到党纪政纪处分的，按照影响期长的规定执行。”也就是说，根据目前的规定，这四名干部所受的影响从理论上来说相同的。\n\n需要厘清的一点是，免职、辞职不等同于撤职，也不等同于辞去公职，除非另有党纪政务处分，一般仍会保留原先的职级待遇。以曾因襄汾县“9.8”尾矿溃坝重大责任事故引咎辞去山西省省长职务的孟学农为例，2008年9月辞职后，2010年01月任中央直属机关工委副书记，级别仍为正部级。这一点，《关于实行党政领导干部问责的暂行规定》第十条进行了详细的规定：\n\n“受到问责的党政领导干部，取消当年年度考核评优和评选各类先进的资格。引咎辞职、责令辞职、免职的党政领导干部，一年内不得重新担任与其原任职务相当的领导职务。对引咎辞职、责令辞职、免职的党政领导干部，可以根据工作需要以及本人一贯表现、特长等情况，由党委（党组）、政府按照干部管理权限酌情安排适当岗位或者相应工作任务。引咎辞职、责令辞职、免职的党政领导干部，一年后如果重新担任与其原任职务相当的领导职务，除应当按照干部管理权限履行审批手续外，还应当征求上一级党委组织部门的意见。” 一年后，金育辉、李晋修、刘长龙、毕井泉还会不会重新回到领导岗位上呢？让我们一年之后再看答案吧！",
