      "body": "La cosa juzgada es la cualidad que tiene una sentencia, sobre la cual no cabe ningún recurso, por lo tanto se hace inimpugnable e inmutable, es decir, inimpugnable porque nadie puede atacarla con ningún recurso e inmutable porque su contenido no se va a poder modificar. La cosa juzgada nace cuando contra una sentencia ya se ejercieron todos los recursos que establece la ley, y por lo tanto ya no puede ser recurrida, o en aquellos casos donde la sentencia fue dictada en última instancia, y por lo tanto al no haber un superior jerárquico, dicha sentencia no puede ser recurrida, así mismo puede darse en aquellos casos donde aún habiendo recursos, las partes no los ejercieron en los lapsos establecidos por la ley, siendo que en cualquiera de esos escenarios nacería la cosa juzgada.\n\nDebemos diferenciar entre la cosa juzgada formal y la cosa juzgada material, la cosa juzgada formal es aquella cuyos efectos sólo se pueden dar en un mismo proceso, es decir dentro de un proceso judicial no se pueden ejercer más recursos, y por lo tanto nace la cosa juzgada, pero la cosa juzgada formal no impide que se inicie un nuevo proceso distinto al que ya se había iniciado, y que se discuta el mismo asunto, por otra parte la cosa juzgada material, es aquella que causa sus efectos dentro y fuera del proceso, siendo que, la decisión no puede ser atacada en el proceso donde nació ni en procesos posteriores.",

      "body": "El derecho administrativo es una rama del derecho público, que está encargada de regular a la administración pública, al acto administrativo, y a los procedimientos administrativos. Al ser parte del derecho público claramente el derecho administrativo está gobernado por el principio de la legalidad, ahora bien, ya se dijo que tiene por objeto regular a la administración pública, y por administración pública desde un punto de vista objetivo, podemos entender a todas las actividades administrativas, que se realizan en el Estado, ahora bien, la administración pública también puede ser vista desde un punto de vista subjetivo, cuando se refiere al conjunto de órganos y entes que se encargan de prestar los servicios públicos del Estado. En dicha regulación el derecho administrativo le impone sus competencias, funciones, los procesos que deben seguir, los motivos y finalidades, que deben seguir. El derecho administrativo también regula el acto administrativo, y entendemos por acto administrativo, como toda declaración de voluntad emanada por un órgano de la Administración pública que vaya a producir efectos particulares o generales y que esté sujeta a las competencias y procedimientos establecidos en la ley, como vemos, el acto administrativo es la forma en que la administración pública expresa su voluntad, y a su vez es el acto mediante el cual cumple sus funciones, sólo se puede hablar de acto administrativo, cuando dicho acto, es emanado por un órgano o ente, de la Administración pública y no de otro sujeto, Asimismo, se ratifica el principio de la legalidad, al cual el  acto administrativo, debe estar amarrado tanto en  las competencias del organismo que dicta el acto, como a los procesos que debe seguir dicho organismo. Por último el derecho administrativo también rige los llamados procedimientos administrativos, que se diferencian de los procesos judiciales porque estos se dan en la sede administrativa, y no en los tribunales, los procedimientos administrativos se dividen en, procedimientos preparatorios, y en procedimientos de impugnación, los procedimientos preparatorios son todo ese conjunto de pasos que siguen los órganos de la Administración Pública para poder emanar su acto administrativo, y los procedimientos administrativos de impugnación, son aquellos que se inician con la finalidad de dejar sin efectos a los actos administrativos, dichos procedimientos pueden ser iniciados por los particulares que hayan sido afectados por un determinado acto administrativo.",

      "body": "En materia de persuasión hay varios principios que te puede ayudar a convencer a los demás de darte la razón aquí te revelo alguno:\n1) Principio de la Arrogancia; los seres humanos somos arrogantes por naturaleza de manera que somo tendiente a seguir ordenes y opiniones que alimentan nuestra arrogancia, por ejemplo cuando un vendedor te dice que deverias compras esa camisa porque se te ve increíble.\n2) Principio de contraste: si quieres hacer ver mejor algo que tu propones, como una idea sirve mucho hacer la comparación con otra idea o situación menos llamativa para que la tuya resalte, lo mismo se puede aplicar a las veces que tienes un problema.\n3)Principio de la vulnerabilidad: Demuestras tu lado más vulnerable te sirve para crear empatia y par que las personas crean que eres más honesto, por ejemplo cuando cuentas una historia de algo vergonzoso y haces que todos hagan empatia contigo y te crean y luego cuentas esas cosas que te hacen quedar bien, este ultimo principio úsalo con cuidado porque no querrás que malas personas conozcan tu lado más vulnerable.",

      "body": "En mis años estudiando derecho, quizás una de las cosas que más me perturbaba el pensamiento, es el caos que se vive en la sociedad cuando el derecho no es respetado,  recuerdo cuando apenas estaba en primer año de derecho, allí estaba yo, un bachiller sentado en una Universidad escuchando a un abogado que le daba clases, hablar de lo que era el derecho, antes de seguir debo decir que basto mi primer año en la universidad, para que mi forma de ver a los abogados cambiara, yo estudie derecho para hacer dinero, objetivo que aún tengo, pero recuerdo que mucha gente tiene la imagen del abogado como un tramposo, un mentiroso que solo se aprovecha de los demás cuando usa la  ley, cosa que hoy en día muchos aun piensan, lo irónico es que a pesar de indignarse de la supuesta forma de ser de los abogados, estas personas no son precisamente los más dedicados a respetar los derechos de los demás, pero bien, en aquella clase el profesor dijo que el derecho es un mecanismo de control social, que busca que lo que es, sea lo que debe ser, si todos nosotros entendemos esas palabras podemos concluir que el derecho sera ese mecanismo que utilizaremos para armonizar nuestra propia vida en sociedad, por eso es alarmante, el irespeto e ignorancia de los pueblos hacia el derecho, que es justamente su propio protector, es como si un policía fuera a una balacera y se quitara al propósito el casco y el chaleco antibalas, ver como los gobernantes utilizan mecanismo para escapar del control de la ley e inclusive, de utilizar el derecho en su propio beneficio y en detrimento de los demás, de  manera que ya no abría igualdad ante la ley, al final el problema es que en las leyes se puede describir el país perfecto pero el proceso para materializar ese ideal, esta frenado por la falta de capacidad de sus ejecutantes, y por las trabas de aquellos que tiene interés contrarios, y llegado a este punto seguro te estarás preguntando cual entonces es la manera de darle eficacia al derecho en la sociedad y ordenar el caos que se vive en gran parte de los países del mundo, y si bien no hay una respuesta precisa, yo argumentare que gran parte de lo que puede ayuda a ese proceso es; La cultura; una cultura llena de valores y unidad es necesaria para todo el desarrollo de un país, educación; solo la educación nos hará sacar lo máximo de nuestras sociedades y en contraposición por ignorantes hemos padecido grandes penas, y por último rescatar la buena imagen del derecho y fomentar la cultura jurídica, si la gente no sabe que esta siendo victima de una injusticia no se defiende, hoy en día se tiende a creer que las autoridades pueden hacer lo que quieran escudados tras un uniforme y un cargo, cuando en realidad están obligados a servir a los civiles, al final es como se dijo luego de la segunda guerra mundial, el verdadero respeto de los derechos humanos no esta en los organismos internacionales, sino en la forma de actuar de los ciudadanos, quizás cuanto más sepamos de derecho más podremos defenderlo, y construir mejores sociedades.",
