      "body": "El tema se encuentra regulado en la Ley para la Protección de la Fauna Doméstica Libre y en Cautiverio (Gaceta Oficial N 39.338, del 4 de enero de 2010). Al respecto se plantea la discusión acerca de precisar si los animales tienen derechos o no. Conforme al Derecho venezolano, los bienes, cosas, animales y las plantas no son \"sujetos de derecho\"; por el contrario, son \"objeto de derecho\", que es muy distinto. Los animales no gozan del poderío, facultad o potestad, tanto jurídica como fáctica, para hacer valer y ejercitar \"derechos\", ni pueden hacerlos cumplir. En razón a ello, el derecho de obligaciones y el régimen de los derechos reales hacen posible preservar las diversas especies de animales.\n\nLa Ley para la Protección de los Animales regula en el artículo 18 que toda persona que ejerza la propiedad o tenencia de animales domésticos está obligada a brindarle protección, además de evitar la generación de daños a terceras personas y bienes. De forma que quien ejerza la propiedad o tenencia de animales domésticos está obligado a reparar los daños que éstos causen, de acuerdo a lo establecido en el Código Civil venezolano.\n\nAsí mismo, la Ley bajo comentario regula en el artículo 72 y siguientes, un listado de conductas previstas como infracciones graves sancionadas con multas que van desde cuarenta unidades tributarias (40 U.T.) a cien unidades tributarias (100 U.T), y precisamos algunas de ellas: el maltrato de animales domésticos que genere dolor o lesiones independientemente de su tipo; los actos de crueldad por dolo o culpa; la práctica de mutilaciones, exceptuando las que se lleven a cabo quirúrgicamente en beneficio de la propia existencia del animal; la negligencia o impericia en el manejo de los animales, provocando daños a personas o sus bienes; la exposición de animales a trabajos que les ocasione inmovilización y consecuente daño o dolor; la propiedad y tenencia de animales declarados expresamente como riesgosos y peligrosos de conformidad con la presente Ley.\n\nA título conclusivo es importante aclarar que desde la entrada en vigencia de esta Ley destinada a la protección de los animales, la misma no les concede derechos. En efecto, es un error afirmar que la ley otorga derechos a los animales. Los animales no tienen derechos. Por último, el artículo 33 de la presente Ley establece que a partir del treinta y uno de diciembre de 2014 queda prohibida la propiedad y tenencia de caninos pitbull.
