      "body": "‘It is not true that good can follow only from good and evil from evil but that often the opposite is true'.\n— Max Weber\n\nBased on this approach, the notion of dirty hands and the sense of making a wrong decision for the greater good and achieving a positive outcome in the long-term is widely accepted.\n\nNevertheless, torture extends any ethical borders and has been, justifiably, prohibited by international law.\nEven after being ordered by a superior officer or authority, this text supports that torture is the most inhuman measure to acquire information.\n\nFurthermore, even if the state neglects international legislation and performs this cruel act, it’s proven to be an ineffective method, and its prohibition is entirely justifiable.\n\nThe aim of the particular dirty hands model is misplaced, and the politician is far from protecting the people, but the state commits a legitimized violation of human rights, for an act which most of the time is useless.\n\nThe model of dirty hands in politics is presented in Michael Walzer’s book entitled “Just and unjust wars” (1978). ​The term ‘dirty hands’ is defined as the debate on whether politicians can use gravely immoral actions for the greater good.\nFor instance, this is a paradox even with the title’s phrase: ‘just wars.’ Although this goes against the deontological rule of avoiding the murder of another human, killing the enemy for the protection of one’s country is justified in terms of warfare.\n\nAnother essential term must be introduced to comprehend the connection between the ‘dirty hands’ model and torture: Utilitarianism.\n\nIn Jeremy Bentham’s writings, utilitarianism was defined as the greatest extent of people’s happiness; all people count for one and not for more than that. The idea of morality should be measured by the consequences of actions in pain and pleasure.\n\nThe UN General Assembly resolution 39/46 (1984) states: ​‘No exceptional circumstances whatsoever, whether a state of war or a threat of war, internal political instability or any other public emergency, may be invoked as a justification of torture.’\n\nThe problems of using such an immoral act, even in the dirty hands’ framework, show why the complete ban is rightfully established. First and foremost, the most crucial factor is the consideration of the human being who is tortured. ​There is no sense of morality in a dirty hands method that aims to use cruel practices and make unprotected suspects speak, even violating their legal right to remain silent.\n\nSecondly, following the first point, the authorities cannot draw a line in such circumstances, and no official figure understands the limits of a victim and can be sure that this ‘middle-aged' method won’t cause any post-traumatic damage.\n\nAdditionally, as political and social theorist Steven Luke states in his work entitled “Liberal Democratic Torture,” in a liberally democratic society, there can be many types of dirty hands, but torture mustn’t be one of them.\nNot only is this violating international covenants for legal procedures, but it justifies that the part in the dirty hands’ policy that uses torture is harming the dignity of the people, and there’s no morality in this unauthorized case.\n\n\nIt’s an apparent mistake of the dirty hands and the utilitarian policy since these models take immoral actions for the greater good. One cannot assume that the greater good is achieved by violating fundamental rights for other people, just because they are suspects or belong to a different community.\n\nAnother severe issue is the public’s approach towards this cruel act of excruciating pain, ​with 25% of Americans voting that it’s ‘often’ justified and 38% that this is ‘sometimes’ the case. In any other case, people should be ashamed for even considering this act as justifiable, but in this particular situation, it’s the government’s fault for actions taking place, for instance, allegations of torture in the US Guantanamo Bay camp.\n\nOverall, international law has rightfully banned all possible acts of torture and cruelty since they violate fundamental human rights, undermine democratic processes, and judge upon a particular community, disregarding any effects of the severe inhuman sufferings for criminal suspects.\n\nHowever, the main counterargument is based on Bentham’s model of the ‘ticking bomb scenario,’ in which the discussion is upon whether it’s ethical to torture a captured terrorist who has information about a bombing attack that will kill many innocent lives.\n\nBased on this dilemma, many people consider the act of torture justified in some cases and don’t entirely agree with international law. First of all, this case cannot prove the whole argument since it’s an imaginary situation. In reality, there are many problems, such as cases where the captured person isn’t affiliated with the group or doesn’t have enough information, with the justification of torture only being applicable in this ideal case.\n\nAdditionally, the majority of the actual cases in these circumstances haven’t been solved by torture; that’s why the complete ban is also a response to the ineffectiveness of torturing as a dirty hands model.\n\nThe Committee Study of the Central Intelligence Agency’s (CIA) Detention and Interrogation was a report from the United States Senate Select Committee on Intelligence (SSCI) that has drawn the conclusion that any type of torture provides misleading or false information.\n\nMore specifically, authorities have faced issues such as interrogating unknown detainees, ​who not only proved to be uninvolved but, as a consequence, their information was inaccurate and false. In general, such practices of enforced interrogation isn’t enough to save other people’s lives and serve the dirty hands policy. \n\nFor instance, Khalid Sheikh Mohammed was a terrorist involved in the 9/11 attacks and captured by the CIA.\n‘Torturing is the way that good guys get bad information with ugly methods’ \n— John Schiemann\n\nAnalysts have shown that suspects, who possess information about a particular event, will be more likely to give false information when exposed to acts of suffering. This is another approach that can justify the absolute prohibition of torture. There are many cases of dirty hands thinking being immoral and still useful, but this is not one.\n\nThe notion of international law being absolutely against any torture is entirely right and justified, mainly for two reasons. The first one is the violation of human rights despite the utilitarian approach followed.\n\nOne cannot suffer such cruel attacks and be unprotected, even if a government deems it necessary for protecting a higher and a more fair number of innocent lives.\n\nThe second reason is the ineffectiveness of the method of torture. Even if governments were authorized to exercise it legally, this wouldn’t protect other innocent lives but the continuation of a brutal dirty hands policy that almost always harms the wrong people or acquires inaccurate information from the right people.\n\nNo parameter should be neglected, and this immorally undemocratic method should be banned and excluded from the dirty hands’ policy, which can be practical and moral in many other cases.",
