| body | The Wage Gap is a very controversial subject these days. In debates discussing the so-called Wage Gap you may have heard many debaters say that Equality of Opportunity is desirable, but Equality of Outcome could be undesirable and even dangerous. The first several times that I heard this statement I agreed with it, and it seemed to make sense. But I have found that I best understand an argument when I try to explain it myself. So for my own sake, here is my explanation of why Equality of Opportunity is a desirable goal, while Equality of Outcome isn't, how that argument is relevant to the Wage Gap discussion, and why it may not be possible to have both Equality of Outcome and Equality of Opportunity without limiting freedom of choice. I understand concepts best when they are explained using analogies, so I am going to create an analogy for this topic. Let's pretend that we have a Law Firm called Premium Law, LLC. This law firm is growing rapidly, and it has way more potential business than it can handle. In order to keep up with the growing business, the law firm hires two new employees: Keith Burgess and Patti Reynolds. Now the Wage Gap argument usually starts with people saying that employees should get equal pay for equal work, but it is really difficult to determine what "equal work" even means. What if one employee gets twice as much work done each hour? What if one employee makes fewer mistakes? What if one employee has a Master's Degree and 15 years of experience, and the other employee just graduated from High School, and as a result of education and experience the employee with the Master's Degree does the work faster and more accurately? What if one employee is really, really good with people skills and marketing and brings in twice as many clients as another employee? I have found that analogies work best when they are simple, so let's assume that Keith and Patti are identical employees. They have identical personalities, work ethics, education, productivity, intelligence, etc. Since the law firm has way more work than it can handle, the law firm has a policy that employees can work as many hours as they want each week as long as they work at least 30 hours per week. Patti and Keith are offered the exact same number of holiday, vacation, and sick pay and are given the exact same health benefits, retirement package options, etc. Employees that work more than 40 hours per week, (including paid leave hours), are paid an overtime rate of time and a half for each hour over 40 hours. **Patti** is hired at a rate of **$45.00 per hour**. **Keith** is hired at a rate of **$42.00 per hour**. Patti's husband has a good job. Patti also has a son with a terminal illness, and she wants to spend as much time as possible with her son before he passes away. Between working hours and paid leave, Patti chooses to work a standard shift of **40 hours per week.** Keith's wife is a stay-at-home mother. His daughter suffers from severe cerebral palsy, and Keith and his wife are trying to save up enough money so that they can pay for a special wheel chair for their daughter and so that they can upgrade their house to be fully accessible for that wheel chair. Between working hours and paid leave, Keith works **60 hours per week.** Let's do the math and see how much each employee makes by the end of the year. In an average year, there are 2,088 working hours if an employee works 40 hours per week, so **Patti worked 2,088 hours for the year**. Multiplying 2,088 by 60 and dividing it by 40 tells us that **Keith worked 3,132 hours for the year, which is 2,088 regular hours and 1,044 overtime hours**. This means that the annual income for each employee is: Patti: $45.00 per hour X 2,088 hours = $93,960 Keith: $42.00 per hour X 2,088 hours + $42.00 per hour X 1.5 X1,044 hours = $153,468 When researchers measure the wage gap for the sexes, they usually compare ANNUAL incomes. So if researchers were comparing Patti and Keith, they would say that Premium Law, LLC discriminates against women because Patti, the woman, made less than Keith, the man, doing the exact same job with the exact same qualifications. Patti was discriminated against because she didn't get the same OUTCOME, (annual pay), as Keith. It is absolutely true that they did not receive the same outcome. However, from my perspective I see a much more troubling problem. We have assumed that Patti and Keith are identical employees. To me, it doesn't matter how much they get paid for the year. I am more concerned with what they are being paid PER HOUR. Keith is getting paid $3.00 less than Patti for the exact same work. In this scenario, I believe that Premium Law, LLC is actually discriminating against Keith because they aren't giving him Equality of Opportunity. Both employees have been given the opportunity to work as many hours as they want to work, but Keith only has the opportunity to earn $42.00 per hour for that work, while Patti has the opportunity to earn $45.00 per hour for that work. If our goal is to make sure that both employees receive equal OUTCOMES, what could the government do to make that happen? Here are several options: **Option 1:** Legally force Patti to work 60 hours per week. If Patti works as many hours per week as Keith, in this scenario the wage gap will then be in Patti's favor, which at least would make it no longer look sexist against women. What are the possible negative repercussions of doing this? Well, Patti doesn't really need the extra money. She makes a decent salary, and her husband is contributing fully to the family's bills. What she values most is the precious extra time that she wants to spend every day with her dying son. Also, the extra hours could add stress to Patti's life that could impact her health and even decrease her lifespan. **Option 2:** Legally force Keith to only work 40 hours per week. If Keith has to limit his hours to the same number of hours as Patti, he will stop making more than she makes. The potential negative repercussions of this decision mean that Keith's daughter may not be able to get the wheelchair and the ADA home that would improve her quality of life. Although Keith might benefit from a health standpoint and from being able to spend more time with his loved ones, he has clearly decided that at least in the short-term providing for his family is his higher priority. **Option 3:** Make both employees exempt employees that are paid an annual salary that doesn't change based on the number of hours the employees work. Likely, in this scenario both employees will choose to work the same number of hours since there is no benefit to working more hours than is necessary. This is perhaps the best of the options so far; however, it still means the employees have less choice and less control over their lives. **Option 4:** Increase Patti's hourly wage and/or decrease Keith's hourly wage to the point that Patti makes the same amount in 40 hours as Keith makes in 60 hours. This will INCREASE the disparity in the hourly rates, thus increasing the Equality of Opportunity problem, but it would eliminate the Equality of Outcome problem. I'm sure there are other ways to eliminate the Equality of Outcome problem, but I can't think of a single scenario that wouldn't limit the choices of the employees in some way. Allowing the employees to adjust the hours they work to achieve the goals they want to achieve seems to be the best scenario for everyone. How can we eliminate the Equality of Opportunity problem? Easy, pay Keith and Patti the same hourly rate. Since the company clearly can make a reasonable profit while paying Patti $45.00 per hour, Premium Law, LLC needs to raise Keith's wage to $45.00 per hour. Based on this analysis, I believe it is desirable to strive for Equality of Opportunity, but I don't really care about Equality of Outcome. I do care if someone's outcome is really terrible, for example, someone who works 40 hours per week who has very modest expenses, but who still cannot make basic ends meet. We do have very real problems in this society that we need to solve. I do care about someone who has trouble asking for the wage they deserve simply because they are too agreeable. But I also truly believe it when experts say that the so-called Wage Gap, in other words people getting paid different rates SOLELY on the basis of their gender, isn't a real thing, or if it is a real it actually is biased in favor of women. I'm not saying this because I believe my specific analogy is true. I'm just saying that I can easily see that if on average men work more hours than women and researchers are only tracking annual income it will obviously make it look like a phantom Wage Gap exists when it isn't really there. |

| body | Does filling out your taxes stress you out or make you angry? The IRS has many problems, and we can't solve them all at once, but we can fight back in one small, easy way. Let's decrease the Statute of Limitations on taxes from 3 years to 1 year! This is a very easy change to make, and there is literally no good argument against it. **_What would this mean?_** Right now, legally the IRS can audit you for any reason for up to 3 years after you file your taxes. This means that you have to keep all of your paperwork and have to worry about the possibility of the audit for 3 years. If we changed the Statute of Limitations to be 1 year, the IRS would not be able to legally audit you after a year after you file your taxes unless they could prove you misstated your income by at least 25% or had committed fraud. Can you imagine how good it would feel if the IRS tried to audit you 1 year and 1 day after you filed your taxes to be able to tell them that they legally have to leave you alone? We can easily make that a reality!!! **_How hard would this change be to make?_** It is REALLY easy. All law makers have to do is change the number **3** to the number **1** in an already existing law. The law for this Statute of Limitations is found in 26 U.S. Code § 6501 - Limitations on assessment and collection in paragraph a. All it would mean is that the IRS would have to actually be efficient. I'm guessing this is because if they actually find anything they can charge a lot more for interest penalties. This might make sense if filing taxes was an easy, simple, straight-forward process, but the reality is that even a CPA can mess up a tax return, and there are so many gray areas that even if you get it right you could get into trouble. Also, with the IRS you are considered guilty until proven innocent, and the IRS can audit you if they even SUSPECT you might have messed something up. Also, the taxpayer has roughly 3 months to file his or her taxes. Why on earth should an average taxpayer be given only 3 months to prepare the taxes, but a large entity like the IRS that is full of professionals is given 3 years to audit that tax return? I'm guessing the reason the IRS is given 3 years to audit the tax return is because the taxpayer is given 3 years to amend it in case the tax payer wants to for example take a net loss back 3 years. But this wouldn't cause any problems. If a taxpayer refiles his or her taxes, then the new filing date on the updated taxes would give the IRS another year to audit the new filing. There is absolutely no practical reason why the IRS needs the same amount of time to audit filings as taxpayers have to amend filings. I can see why a surface level review would make someone think that needed to be the case, but it simply doesn't. Also, because the IRS receives a new batch of tax returns every year, anything beyond a year doesn't give the IRS more time to do their job. If an IRS is auditing 300 tax returns over 3 years or 100 returns over 1 year he or she still has to audit 100 returns per year. Honestly, I would be in favor of dropping the audit time even lower, but 1 year just makes sense. It's a clean number that everyone can remember. Changing this Statute of Limitations doesn't have to, and should not, change any other IRS rules or regulations. The IRS is essentially paid to be inefficient. The IRS has all of the power. This is just the first of many reforms that I believe should be made to put the taxpayer back on slightly more even footing with the IRS. If we have to be subjected to an audit, we should at least be audited close enough to our filing that we are still in contact with our tax preparer, that we still remember most of the things that happened that year, and close enough that we are more likely to have a similar income and savings from that income. Almost everyone I have seen get audited was audited after losing their jobs. It's nearly impossible to pay off taxes from three years ago when you have been without a job for 2 of those 3 years. **_What do I need from you?_** 1) Contact your Senator and Representative if you live in the United States. Tell them that you support this bill. I am contacting my Senator and Representative, but this needs to come from multiple people. Chances are, your Senator and Representative will not have heard of this bill. Just tell them to support dropping the IRS Statute of Limitations from 3 years to 1 year in 26 U.S. Code § 6501 - Limitations on assessment and collection in paragraph a. Does that sound intimidating? It's actually really easy! You can contact your Senator or Representative by email, by phone, or even by regular mail. Your request may get assigned to an assistant, but it will be heard. Make sure you let them know that you are their constituent! All stations need to have stories on hand for slow news days, so some might be open to it. Be creative. Share any way you can. This is a very simple, very straightforward, easy change that our lawmakers can make. It would help many, many people every year, including you if you are a US taxpayer. It doesn't take a ton of people to make a difference. I need you! Think how great it will feel to know that you have actually been involved in our government. When the bill passes, you can tell your family and friends and neighbors - I was part of that. I was there in the beginning days when only a few people were working on this intitiative. The IRS has to leave you alone because I made a difference. Not everyone can do both things. Maybe you are not a US citizen. Maybe the idea talking to your Representative or Senator is just too overwhelming. But if you can do EITHER thing, every little bit helps. Share this idea over and over and over again. | body | Compromise is an important art that allows our country to exist and to thrive. Back in the 90's it felt like most people understood the importance of compromise, and most people honored compromises. Today it now feels like most people, especially on the left no longer see compromise as an important thing. First, let's discuss how a compromise should work. Let's say you have two roommates sharing an apartment - Tim and Gary. Tim and Gary both hate cleaning the bathroom, and Tim and Gary both hate doing the dishes. They also both want to have a clean bathroom and clean dishes. If Tim got his way, Gary would always clean the dishes and always clean the bathroom. If Gary had his way, Tim would always clean the dishes and always clean the bathroom. Tim and Gary value their friendship and want to live in peace with each other, and so they decide to compromise. In this compromise, both Tim and Gary will agree to do something that they don't want to do, with the assumption that the other person will do the same thing. Tim and Gary decide that the bathroom should be cleaned once per week and that the dishes should be washed after every meal. Tim and Gary agree that next week Tim will clean the bathroom and Gary will do all of the dishes. Then the week after they will swap. Gary will clean the bathroom and Tim will wash the dishes. They will keep swapping back and forth every single week until they stop living together or until they decide to officially get together and both agree to a different plan. This compromise seems fair. Both parties are giving up something and they are meeting in the middle. They both officially agreed to the compromise. And they both have to agree if they decide to change the compromise. But this compromise only works if each party to the compromise is dedicated to holding up his own end of the compromise. Even though he doesn't enjoy it, Tim needs to step up and make sure he cleans the bathroom the first week. And Gary needs to clean the dishes even though he doesn't enjoy doing that. You see, in a compromise you are most responsible for doing the part you didn't want to do. You must commit to looking after the rights of the other person. In this scenario, Tim could theoretically let Gary clean all of the dishes the first week and just pretend like he is going to clean the bathroom. He could probably get away with it for one week, but if Tim doesn't honor his side of the compromise Gary will very quickly resent Tim and will not want to hold up his end of the compromise. Also, Tim has essentially given his word that he will do his part. Compromise only works when you can trust the other party to honor their promises and obligations. As soon as trust is destroyed the ability to compromise is destroyed. While you can get short term gains by breaking trust, losing the ability to compromise in the long term is a very heavy price to pay for that betrayal. Why is all of this important? Because we have now entered a world where the left seems to take the attitude that today's compromise is tomorrow's starting bargaining position. In our example, let's say that Tim takes the exact attitude. Tim and Gary alternate doing the bathroom and the dishes every other week for 6 months, and Tim calls Gary back to the bargaining table. He then tells Gary that he wants to compromise. He doesn't like cleaning the bathroom. He offers to clean the dishes every other week if Gary will clean the bathroom every week and do the dishes every other week. Gary accepts the offer because Tim hasn't been cleaning the bathroom or doing the dishes, so Gary is just happy to have Tim do anything. Six months later, Tim calls Gary to the bargaining table again and insists on compromising that instead of doing the dishes every other week, he will only do the dishes once every three weeks. Every time he gets his way, he takes his girlfriend out to celebrate and says, "I'm making so much progress! I absolutely hate doing dishes and cleaning the bathroom. It's disgusting, and I don't have time to do it. One day I am going to end the oppression that Gary has over me and I will not have to do either chore. But sometimes you have to make progress in steps. I am fully committed to this process. I have already made so much progress already." How would you feel in this scenario if you were Gary? I know I would be angry. This is not progress. This is Tim being incredibly selfish and dishonest. Little by little, with each step of "progress" Tim is slowly destroying his credibility and is causing Gary to build up resentment towards him. What Tim doesn't realize is that one day he is going to take things too far and Gary is going to snap. Gary may refuse to do any chores and may just let the bathroom and dishes stay dirty. Or he may kick Tim out and get a new roommate. He may come back one day and say, "I have been doing all of the chores for an entire year, now. In order to make things fair, you must either do all of the chores for a year, or I am kicking you out of the house." He will likely lose his friendship with Gary. And most importantly, Gary is not oppressing Tim or taking advantage of Tim by asking him to do his fair share of the chores in the house. Gary didn't invent these chores. Tim has been doing just as much to make the dishes and the bathroom dirty as Gary has been doing. No matter what Tim may believe or what he may say to his girlfriend, Tim is actually taking advantage of Gary. If anyone is being oppressed, Gary is being oppressed by Tim. This is the problem with the left today. Each time the left and right get together to come up with a compromise that both sides can live with, the left treats the compromise as the new starting position for bargaining next time. To a certain extent, they have also been getting away with it. When the left agree to a compromise position with the right, it should be their moral duty to protect all of the rights of the right from that point on. But instead of living up to this moral duty, a few years later the left will start the compromise process all over again pretending that the previously existing compromise is the new starting point and the right has an obligation to meet them at the new half-way point. They may be getting their way, but they have destroyed their credibility. No one trusts their integrity when it comes to compromise. And they are creating a ton of resentment. It is only a matter of time before the right snaps and refuses to ever compromise with the left again. Instead of agreeing to compromise positions, the right will start embracing far-right positions and will refuse to back down from them or negotiate even a little bit. Also, the farther to the left the compromise becomes the more people who started out in the middle end up on the right side of the compromise, and the more people who are feeling like they are being required to make unacceptable compromises to meet the compromise position. The problem with this is that compromise is the process that allows us to live together. Unlike with a terrible roommate, it is very difficult to evict a large segment of the population out of our country no matter which side wins that eviction process. This basically leads to the only two remaining alternatives: tyranny or war. Things aren't so broken yet that they can't be fixed. There are ways the left could act in good faith and show the right that they are once again willing to peacefully compromise. And people who are moving to the far-right could come back to the negotiating table if they see good-faith efforts of the left to be genuinely present at that table. But the left needs to know that the right will not silently submit to tyranny. If we don't get some compromises that both sides can live with and that both sides are willing to honor we are sadly on a path to war. And a bunch of innocent people in the middle will also be caught in the middle of that war. |
