This means that by advertising returns on investment, USITech fall into a financial services provider role. The key word in all of this is investment as it directly relates to finance. Offering a financial product requires the owner to release a disclaimer outlining all risks and liabilities. The laws associated with dealing in a financial product are similar in Australia and disclosure is also required. **2d: Legality of Bitcoin packages** The two distributors are said to have advertised that the Bitcoin Packages (BTCP) were certified legal products in the USA per the Federal Trade Commission (FTC) however the FTC has no jurisdiction over Bitcoin Packages. It was the state securities board who were required to register the product and unfortunately USITech did not register Bitcoin Packages with them. In Australia, Bitcoin packages are unregulated however Bitcoin and other cryptocurrencies are currently seen as an investment and as ASIC (ref 5) points out you will need to pay capital gains taxes on any Bitcoin investments. There appears to be no onus on USITech to register Bitcoin Packages as a product at this time. **CONCLUSION** In summary, USITech has failed its distributors in the US and Canada firstly by withholding contractual and legal information imperative to their investments and secondly failing to support the distributors who were without guilt upon USITech’s exit. In my opinion, this conclusion is not fact nor should it be taken as such however my opinion is the future of USITech in Australia appears to have a greater likelihood of survival considering Australian legislation has not yet been applied to a majority of cryptocurrency applications. According to the Texas state securities board USITech’s violations included: Withholding information on facilities used in the mining of their Bitcoin and all costs associated and whether or not USITech has the financial position which can sustain a 1% daily return. They failed to disclose material that investors require in order to make informed decisions about the investment. \n\nAs mentioned in 2a, In Australia, when “you provide a financial service if you “provide financial product advice”; or “deal in a financial product”. This means that by advertising returns on investment, USITech fall into a financial services provider role. The key word in all of this is investment as it directly relates to finance. Offering a financial product requires the owner to release a disclaimer outlining all risks and liabilities. The laws associated with dealing in a financial product are similar in Australia and disclosure is also required.\n\n**2d: Legality of Bitcoin packages**\n\nThe two distributors are said to have advertised that the Bitcoin Packages (BTCP) were certified legal products in the USA per the Federal Trade Commission (FTC) however the FTC has no jurisdiction over Bitcoin Packages. It was the state securities board who were required to register the product and unfortunately USITech did not register Bitcoin Packages with them.\n\nIn Australia, Bitcoin packages are unregulated however Bitcoin and other cryptocurrencies are currently seen as an investment and as ASIC (ref 5) points out you will need to pay capital gains taxes on any Bitcoin investments. There appears to be no onus on USITech to register Bitcoin Packages as a product at this time.\n \n**CONCLUSION**\n\nIn summary, USITech has failed its distributors in the US and Canada firstly by withholding contractual and legal information imperative to their investments and secondly failing to support the distributors who were without guilt upon USITech’s exit.\n\nIn my opinion, this conclusion is not fact nor should it be taken as such however my opinion is the future of USITech in Australia appears to have a greater likelihood of survival considering Australian legislation has not yet been applied to a majority of cryptocurrency applications. It should be noted however that advertising to anyone about USITech investments, returns on investment and commissions for affiliation should be avoided unless you are registered with ASIC as a financial services provider. | body |  Steemit says I should write my story. How on earth can any grown up do that? There's streaking, booz, church, boys, kids, islands, power lines, lesbians, cults and midgets. I have to assume they mean tell one story? I'll give it a go. There's always been this total fire in my belly, about whatever is exciting at the time. This is why I don't have telekinesis, because I'd be so worked up there'd be shit everywhere. I'm mostly passionate about the state of the world and Bitcoin but other things like information and family consume me aswell. I am a mum and a google junkie, which means when my toddler is sick, he's got something lethal and when someone is wrong on the internet the kids don't get dinner until 9pm. I grew up on a small Island with 2 mum's, a mullet and a school of about 60 kids. My dad lived next door with his new wife and I had 7 brothers and sisters. I hardly wore shoes and never a school uniform, mostly because we couldn't afford it. Our family was super interesting to all the other families on the island and we were often the center of gossip. The best thing about being a kid is I never even realized the community thought our little family was a bunch of weirdo's (explains the no friends thing in hindsight) and can mostly just remember adventures. Down the road were the drawf couple who had a pool and furniture for kids. Hindsight aswell. Eventually my mum's got itchy and moved from the Island to the mainland which meant no more boring barge trips and some groceries from a real supermarket. Still having 2 mums and too many brothers and sisters meant there weren't friends at the new school either but highschool was around the corner as was my first swear word. It wasn't until my third day of high school that my mums let me catch the train with my brother, this would have been less embarrassing if they'd also let me wear a schoolbag instead of the wheeling a suitcase (apparently backpacks were bad for young backs so I had my own luggage). At the train station on the way home from school, my brothers friends put a plank of wood on my suitcase and used it as a bike jump. Handy but first impressions last. After almost a year of luggage and bike jumps I decided it was time to move to dads and live a little. Dad gave me enough freedom to roam and enough rules to... break. It's true about the company you keep and unfortunately I was very easily led. At 16 I had moved from my dads, couch surfed until someone could trust me enough to rent me a house and became the most popular kid in high school. Lucky for me, I loved school and therefore kept at it while working 3 jobs, one was running the greatest party house in history. After I finished high school I decided to go on the straight and narrow. Due to doing things in the extreme I chose to be a police officer. After 2 years of study my brain exploded and I realized there was no way I could still be a human after seeing what they see. So I tried working with young people with disabilities so that I would't use my humanity (see what I mean, one extreme or the other). Long story short, best. job. ever. Then, 5 years later, met a great guy, moved to Tasmania which is super cold and sold the locals heat packs. Thus making a killing. Two became three, as we house-sat around the country with tiny people and hardly any work. The in laws welcomed us in the hope that we would come to our senses and settle down, maybe buy a house. Little did they know, it's one thing to have one black sheep in the family but when there's two, they ain't settling down and buying a house, they are moving to a cult. It wasn't really a cult, dont worry, it was more of a big group of human rights activists who did nothing but fight for the rights of our citizens. Well that had a time stamp of 3 years and we had some catching up to do. We were like batman and barbie, sort of awesome but could have done better. Bitcoin came along and our human rights and freedoms inner voice screamed at us to get on the bus. So we did and have been sitting up the back with the cool kids ever since. |
