      "body": "En el análisis jurídico de los hechos, el tribunal parte de la aplicación de la Directiva 2000/31 de servicios de la Sociedad de la Información, en virtud de la cual se excluye la responsabilidad de los prestadores de servicios intermediarios por una actividad ilícita iniciada por un tercero cuando su prestación consiste en una «mera transmisión» de información. Esta exclusión de responsabilidad se aplicará siempre que se cumplan tres requisitos acumulativos: que el prestador 1) no haya originado él mismo la transmisión, 2) no haya seleccionado al destinatario de la transmisión y 3) no haya seleccionado ni modificado los datos transmitidos.\n\nEn la sentencia dictada, el Tribunal de Justicia constata, en primer lugar, que la puesta a disposición del público de una red Wi-Fi de modo gratuito para llamar la atención de potenciales clientes sobre los productos o servicios de un comercio constituye un «servicio de la sociedad de la información» contemplado por la citada Directiva, y en aplicación de la misma, al cumplirse los requisitos establecidos por la norma, considera la ausencia de responsabilidad del administrador de la sociedad titular del comercio; si bien, recomienda, como medida de protección de la red con una contraseña de acceso como medida que pueda garantizar un equilibrio entre, los titulares de derechos de propiedad intelectual y, en este caso, el derecho de libertad de empresa de los proveedores de acceso y el derecho a la libertad de información de los usuarios de la Red.\n\nEsta sentencia, en mi opinión es impecable en cuanto al razonamiento jurídico en aplicación de la normativa vigente y el ámbito en el que se lleva a cabo la reclamación, es decir un ámbito civil, en el que se exige una indemnización por daños y perjuicios derivada de una supuesta vulneración de los derechos de propiedad intelectual.\n\nAhora bien, y llevándonos el supuesto de hecho a nuestro ordenamiento jurídico ¿debería resultar aplicable este mismo razonamiento si el ámbito jurisdiccional fuera diferente? Es decir, ¿debería operar el mismo régimen de responsabilidad si en lugar de la descarga de una creación musical, la actuación ilícita tuviera una calificación penal, por ejemplo: amenazas, daños informáticos, etc.?\n\nEn este sentido, debemos señalar que, a grandes rasgos, puede decirse que hay dos contextos completamente distintos en los que el derecho español en cuanto al régimen de “responsabilidad”: el penal y el civil.\n\nLa Directiva 2000/31 fue incorporada a nuestro ordenamiento jurídico en la Ley 34/2002 de Servicios de la Sociedad de la Información (en adelante LSSI). Obviamente esta norma, al regular la responsabilidad de los prestadores de servicios de la sociedad de la información señala en su artículo 13 que:\n\n“1. Los prestadores de servicios de la sociedad de la información están sujetos a la responsabilidad civil, penal y administrativa establecida con carácter general en el ordenamiento jurídico, sin perjuicio de lo dispuesto en esta Ley.\n\n2. Para determinar la responsabilidad de los prestadores de servicios por el ejercicio de actividades de intermediación, se estará a lo establecido en los artículos siguientes.”\n\nEste precepto establece el régimen de responsabilidad de los prestadores de servicios de la sociedad de la información en el ámbito normativo aplicable, que, en mi opinión, se refiere al ámbito civil; sin que sus efectos puedan extenderse al ámbito penal. No podemos obviar que la LSSI es una ley ordinaria que, en ningún caso, pueda suponer una modificación del régimen previsto en nuestra Ley Orgánica 10/1995, de 23 de noviembre, del Código Penal.\n\nDe esta forma, el Derecho penal hace referencia a los delitos y faltas y a las penas que se deben imponer a las personas que sean “responsables penalmente” de ellos, sea por haberlos cometido, o haber sido inductores, cooperadores necesarios o cómplices, etc. de acuerdo a los preceptos establecidos en nuestro código penal.\n\nEl vigente Código Penal español, al igual que el derogado y la mayoría de Códigos Penales de los países de nuestro entorno, tiene una norma especial en materia de participación y responsabilidad para delitos y faltas cometidos a través de “medios de difusión”. La norma a la que nos referimos es la del artículo 30, que textualmente establece lo siguiente:\n\n“1. En los delitos y faltas que se cometan utilizando medios o soportes de difusión mecánicos no responderán criminalmente ni los cómplices ni quienes los hubieren favorecido personal o realmente.\n\n2. Los autores a los que se refiere el artículo 28 responderán de forma escalonada, excluyente y subsidiaria de acuerdo con el siguiente orden:\n\n1º.- Los que realmente hayan redactado el texto o producido el signo de que se trate, y quienes les hayan inducido a realizarlo.\n\n2º.- Los directores de la publicación o programa en que se difunda.\n\n3º.- Los directores de la empresa editora, emisora o difusora.\n\n4º.- Los directores de la empresa grabadora, reproductora o impresora.\n\n3. Cuando por cualquier motivo distinto de la extinción de la responsabilidad penal, incluso la declaración de rebeldía o la residencia fuera de España, no pueda perseguirse a ninguna de las personas comprendidas en alguno de los números del apartado anterior, se dirigirá el procedimiento contra las mencionadas en el número inmediatamente posterior”\n\nLógicamente este precepto habla de medios de difusión mecánica y se centra en delitos cometidos a través de organizaciones mas cercanas a los medios de comunicación tradicionales, prensa, radio, televisión, etc.. No obstante, y sin aplicación obviamente criterios analógicos excluidos de nuestro derecho penal; existen ciertas actividades y estructuras en la red que responden a los mismos esquemas de funcionamiento y organización, que los medios de comunicación y que, consecuentemente, pueden responder al mismos esquema de responsabilidad establecidos por el artículo 30 del código penal.\n\nDe ser lo anterior cierto, resultará que muchos de los intervinientes en los procesos de comunicación, incluso los simples responsables de las emisiones o difusiones, podrán tener la consideración de responsables penales, aún cuanto, tengan la consideración de prestadores de servicios de intermediación, y la normativa en materia de servicios de la sociedad de la información, presuma su ausencia de responsabilidad.\n\nPor este motivo, y dado que la responsabilidad penal devendría en cascada, podría ser recomendable para estos simples emisores o facilitadores de redes de comunicación –distintos de los Operadores de Telecomunicaciones-, que implanten, no sólo mecanismos que limiten el acceso a las redes, tales como contraseñas o claves de acceso, si no que llevar a cabo labores actividades adicionales que permitan la identificación de aquellas personas que pudieran cometer actos delictivos a través de su red. A los efectos de que, en caso de aplicarse el artículo 30 del código penal, pudiera lograrse una identificación que excluyera su responsabilidad escalonada.",
