While the IRS may consider the receipt of the new cryptocurrency taxable, “tax experts say there has been no guidance on how to treat the sudden receipt of bitcoin cash,” according to the Wall Street IRS May Consider Bitcoin Cash Fork Taxable IncomeJournal on Friday. The news outlet added that the IRS declined to comment on the issue. “While the IRS has issued guidance on cryptocurrency — labeling it an ‘intangible asset’ for investors subject to capital gains and loss treatment using the realization method — it has not issued guidance on cryptocurrency split or ‘fork’ transactions,” explained CPA Robert A. Green, founder and CEO of Green & Company Inc. He then noted that in the eyes of the IRS, the receipt of bitcoin cash is taxable income, adding that: Bitcoin holders should report the receipt of bitcoin cash on their 2017 income tax returns. Some bitcoin holders delay dealing with bitcoin cash or their exchanges do not support it, making it difficult to retrieve the cryptocurrency soon after it was created. However, the “IRS could apply the constructive receipt of income doctrine to argue the bitcoin holder had access to bitcoin cash but turned his or her back on receiving it,” he detailed. A buy-side tax specialist at Deloitte, Jim Calvin, thinks that the receipt of bitcoin cash could be taxable this year for technical reasons, the Wall Street Journal conveyed his explanations: Recipients would have ordinary income, although the amount isn’t clear. It could be based either on the value of bitcoin cash when issued or when investors could trade it…Bitcoin cash recipients could owe tax this year at rates as high as 39.6%. It’s unclear whether the 3.8% net investment income tax would also apply. Bitcoin Cash Could Be Treated as ‘Property Division’ On the other hand, the IRS could consider the receipt of bitcoin cash a “property division,” the Wall Street Journal noted, adding that: In this case, no tax would be due until the holder sells or transfers the bitcoin cash. But the cost basis of both bitcoin holdings would need to be adjusted to account for the split. (Cost basis is the starting point for measuring taxable gain after a holding is sold.) The IRS May Want a Piece of Bitcoin Cash This YearInternational law firm Locke Lord LLC wrote that “if the IRS takes the position that the bitcoin split was akin to a stock split, then little if any tax considerations need to be considered at this time.” According to the IRS, “stock splits don’t create a taxable event” although there is a requirement to report the new shares. “You merely receive more stock evidencing the same ownership interest in the corporation that issued the stock.” The agency does demand that the share’s cost basis is adjusted to include the new total quantity of the shares. IRS Is Not Focusing on Bitcoin Cash Currently, the IRS is preoccupied with cracking down on those who evade taxes using digital currency, rather than the taxation of bitcoin cash. Recently, news.Bitcoin.com reported on the agency purchasing Chainalysis’ bitcoin investigation software to detect money laundering as well as potential tax evaders. The IRS is also in the process of seeking information on Coinbase customers. In July, it narrowed data requests to those with $20,000 in any one transaction type in any year during 2013 and 2015. A criminal tax attorney with Kostelanetz & Fink, Bryan Skarlatos, believes that “the IRS got the information it wanted on Americans hiding money in offshore accounts, and it will get the information it wants on Americans evading taxes through virtual currencies.” How do you think the IRS will tax bitcoin cash? If allowed to open for business, the platform would be the country’s first bitcoin exchange. We will definitely at least go into alpha testing at that time if we are not fully operational,” he told news.Bitcoin.com. Long and Short Bitcoin ETFs Filed with SECIt will gain significant exposure to bitcoin instruments, the filing claims, by investing up to 25% of its total assets in a wholly-owned Cayman Islands subsidiary. The subsidiary will invest in long positions in Bitcoin Futures and will periodically sell them to unwind a portion of its positions. It started with Bitpay’s statement which gave Bitcore nodes the choice to use Segwit2x software, instead of the Core reference client as a form of upgrade. Since then Core developers/supporters and Segwit2x developers/supporters have been battling ferociously. These fights were followed by Bitpay and its services being removed from Bitcoin.org, and early Bitcoin adopter and developer Jeff Garzik was removed from the Core repository on Github. Then Bitcoincore.org, a website that represents the official code base, released a statement called “Correcting Misinformation on Segwit2x and Btc1.” “Btc1 is not connected to bitcoin Core in any way,” explains Core’s official announcement. “No regular bitcoin Core contributors support btc1 or have any connection to the project, nor were any involved in the design of its proposed hard fork.” We strongly advise users not to download any Bitcoin full-node software claiming to be an ‘upgrade’ to Bitcoin’s consensus rules without carefully considering the impact of the proposed changes on the Bitcoin system and the level of community support for it. This includes proposed consensus changes in new releases of Bitcoin Core. Replay Attack Prevention The battle has also revolved around discussions of a replay attack which is a network attack where Unspent Transaction Outputs (UTXO) are valid on both chains and used dishonestly. Without replay attack protection a malicious actor can replay the transaction on one chain and also fraudulently claim coins on the other chain. For August 1 the Bitcoin Cash network implemented strong replay attack protection which prevented these issues, and the split was a clean break. Segwit2x (Btc1) software does not have replay attack protection at the current time, and this has been a bone of contention for Core developers. So far, Segwit2x developer Jeff Garzik has received most of the backlash for his participation with the Btc1 code base, hence his removal from Core’s Github. Bitcoin Software Wars: The Battle of Nodes, Hashpower, and Development Shapeshift founder Erik Voorhees not pleased with Jeff Garzik’s removal from the Core Github repo. Core Developer Eric Lombrozo Threatens Cyber-Attackers With Both Technical and Legal Action Bitcoin Core developer Eric Lombrozo says Segwit2x “constitutes a serious cyber-attack” and says action against it will be implemented in both technical and legal form. The problem with this argument is that opposition believes the majority hashpower and business support will be enough for consensus. Further Bcoin & Btc1 developer, Christopher Jeffrey, and many others think Gavin Andresen’s op-return method is sufficient. “Gavin Andresen‘s anti-replay patch carries with it the benefit of preventing the 1mb chain from ever reorging the 2mb chain,” software developer Christopher Jeffrey explains. “As soon as an OP_RETURN [segwit2x] transaction is mined on the 1mb chain, the 1mb chain is now invalid in the eyes of the HF code. I think this should be implemented for both anti-replay and anti-reorg benefits.” Three days ago Jeff Garzik explained that the opt-in replay protection created by Andresen “seems like something they could merge.” Others Segwit2x supporters believe the majority hashpower will be what’s more decisive, because if 90 percent of the hashrate pushes the Segwit2x’s hard fork through, Core software would likely have to split off. This will lead to the legacy chain retaining very little hashrate with a tough mining difficulty.
