      "body": "http://ph.sisain.co.kr/news/photo/201803/31541_60862_0740.jpg\n\n만약 대학(원)생 아르바이트가 대학 내 대부분의 노동자를 대체하게 된다고 가정해보자. 고령의 경비 노동자도, 청소 노동자도 없는 대학. 그런 ‘매끈한’ 대학에서 학생들은 대체 무엇을 배우겠는가? 좋건 싫건 간에, ‘나’는 ‘남’들과 뒤섞여 부대끼며 살 수밖에 없는 존재라는 것, 그것이 우리가 발 딛고 살아가는 세계라는 것. 이 소박하고 준엄한 진리를 전제하지 않고 대학은 교육기관을 자처할 수 있을까? \n\n전국 30만 대학원생의 명예를 위해 단언컨대, 대학원생은 청소를 싫어하는 것이 아니다(자취생인 내게 방 청소가 무척 귀찮은 일임은 부인하지 않겠다). 최저임금 인상과 학령인구 감소를 핑계 삼아 파견 노동, 불안정 노동, 초단시간 노동의 온상이 되어가는 대학의 현 상황이 싫은 것이다. 비싼 등록금을 내면서도 저렴한 노동력으로 취급당하는 대학원생의 처지에 염증을 느끼는 것뿐이다. 이러한 대학원생 처우의 열악함은 우리 사회가 청년 세대를 소외시키고 착취하는 방식과도 직결된다. \n\n진정 대학의 위기를 초래한 것은 무엇인가\n\n등록금 동결과 최저임금 인상으로 인한 재정난을 호소하면서도 매년 새 건물을 올리는 대학. 사기업보다 더 교묘하고 잔인하게 학생과 노동자를 탄압하는 대학을 보고 있자면 진정 대학의 위기를 초래한 것이 무엇인지 묻지 않을 수 없다. 쟁점마다 대학 측이 그토록 강조하는 재정난은 증상의 하나일 뿐이지 원인이 아니다. 진짜 대학의 위기는 대학이 어떠한 진리도 탐구하지 않게 되었을 때, 욕망을 좇아 폭주하는 세계에서 제동장치 구실을 할 청년 양성하기를 포기했을 때 도래한다.",

      "body": "https://img.sbs.co.kr/newimg/news/20180307/201157899_1280.jpg\n\n중국인들은 개를 정말 좋아합니다. 중국 도심 아파트나 공원, 길거리엔 반려견과 함께 산책하는 중국인을 쉽게 목격할 수 있죠. 개인적으론 아파트 엘리베이터 안에 여러 마리 개들과 함께 갇힌 적도 있고, 저렇게 큰 개를 아파트에서 어떻게 기를까 싶은 생각이 들 때도 있었습니다. 인구만큼이나 애견인도 많은 중국이지만, 애견 문화수준은 아직 모자란다는 게 대체적인 평가입니다. 입가리개를 한 반려견은 없진 않겠지만 아직 본 적이 없고요, 개목줄을 하는 애견인도 그리 많지 않습니다. 목줄을 하더라도 5미터 정도되는 길이더군요. 아파트 단지 안은 물론 엘리베이터에서도 배설물이 발견되는데, 요즘 위생봉투를 지참하는 애견인들을 가끔 목격할 수 있는 게 그나마 다행이라면 다행입니다.\n\n중국의 비애견인들도 애견인들에게 가장 큰 불만은 우리와 똑같은 것 같습니다. '우리 개는 절대 안 물어요'라는 애견인들의 생각이죠. 그래도 우리 사회에선 지난해 유명 연예인 가족의 반려견이 이웃 주민을 물어 숨지게 한 사고로 인해 애견인들의 이런 태도가 조금은 환기됐다고 생각됩니다만, 중국은 아직 그렇지 않습니다. 이런 상황에서 최근 중국인들이 자신들의 애견 문화를 되짚어봐야 할 만한 법원 판결이 나와 소개합니다. \n\nhttp://img.almaghribtoday.net/2015/11/normal/almaghreb-today-%D9%83%D9%84%D8%A8-%D9%85%D8%B9-%D8%B5%D8%AF%D9%8A%D9%82%D8%AA%D9%87.jpg\n\n재작년 12월 19일 아침 8시, 랴오닝성에 사는 70대 천 모 씨는 체육관 주변을 산책하고 있었습니다. 체육관 서쪽 주변을 돌고 있는데, 갑자기 개 한 마리가 천 씨 앞으로 다가왔습니다. 자신의 눈 앞으로 달려오는 개를 보고 천 씨는 크게 당황했습니다. 개가 직접 천 씨를 물거나, 신체 접촉을 한 건 아니지만, 개가 한 발 앞 거리까지 다가오자, 천 씨는 두 발정도 뒷걸음치다 땅바닥으로 넘어지고 말았습니다. 이 광경을 목격한 개주인인 샤 모 씨는 즉시 구급대를 불러 천 씨를 병원으로 옮겼고, 경찰에도 신고했습니다.\n\n병원에 입원한 천 씨의 상태는 생각보다 심각했습니다. 경막하출혈, 뇌좌상, 후두골골절, 망막출혈에 고혈압과 당뇨병 진단까지 받았습니다. 결국 입원 치료 23일만에 숨지고 말았습니다. 병원측이 밝힌 사인은 노인들이 낙상으로 주로 발생한다는 '급성 경막하출혈'. 뇌를 둘러싸고 있는 경막 안쪽에서 혈관이 터져 출혈이 발생했다는 거죠. 샤 씨의 반려견이 갑작스럽게 개가 달려드는 바람에 천 씨가 놀라 넘어졌고, 그로 인해 경막하출혈, 즉 뇌경막 안쪽에 혈관이 터져 숨졌다는 얘깁니다.\n\n문제의 반려견은 만 1살이 된 골든리트리버였습니다. 1살이라고는 하지만 다 큰 골든리트리버와 체구는 비슷했습니다. 샤 씨는 반려견을 키울 때 구비해야 할 '강아지 신분증'이 없는 상태였고, 사고가 발생할 당시엔 개 목줄을 묶지 않았습니다. 숨진 천 씨의 가족들은 샤 씨를 상대로 \"반려견 관리를 제대로 하지 않아 천 씨가 숨졌다\"며 법원에 손해배상 청구소송을 제기했습니다.\n\nhttps://vetstreet-brightspot.s3.amazonaws.com/d2/bae640e07e11e09dd312313817c323/file/dog-red-eyes-425mk091511.jpg\n\n법률적인 쟁점은 샤 씨의 반려견이 단지 천 씨에게 가깝게 다가간 것일 뿐인데, 천 씨가 넘어진 것과 더 나아가 숨진 것에까지 인과관계를 인정할 수 있느냐로 모아졌습니다. 1심 재판부에서 \"성장한 골든리트리버가 70대 노인 한발 앞까지 달려든 것은 노인이 충분히 긴장과 공포를 느낄만했고, 그런 이유로 넘어졌다\"고 인정했습니다. 이어 천 씨가 숨진 것도 당연히 천 씨가 넘어져서 다친 것이 원인이라고 판단했습니다. 즉 골든리트리버가 갑자기 다가온 것과 천 씨의 사망과는 법률적인 인과관계가 있다는 결론입니다. 재판부는 또 샤 씨가 골든리트리버의 주인이자 관리인으로서 안전 조치를 제대로 안 해 관리 책임을 소홀해했다며 손해배상을 해야 한다고 판결했습니다.\n\n당연히 샤 씨도 억울하다며 반론을 제기했죠. 반려견이 천 씨에게 갑자기 다가간 건 제3자가 개를 놀려서 생긴 우발적인 일이라는 주장입니다. 이에 대해 재판부는 이런 상황은 숨진 천 씨의 가족들이 소송을 샤 씨와 함께 개를 놀린 사람에게도 청구할 수 있게 할 뿐이라고 판단했습니다. 샤 씨의 책임이 없어지는 건 아니라는 얘기입니다. 샤 씨는 또 천 씨의 고혈압과 당뇨병까지 이번 사건과 연관 지을 수 없는 거 아니냐며 손해배상 책임을 감경해달라고 요구했습니다. 하지만 재판부는 이도 역시 받아들이지 않고, 샤 씨에게 36만 위안, 우리돈 6천백만 원을 배상하라고 판결했습니다.\n\n즉각 샤 씨는 항소했습니다. 2심 재판을 진행한 거죠. 그러나 2심 재판부 결론도 크게 다르지 않았습니다. 공공장소에서 개 목줄이 없는 골든리트리버가 갑자기 달려들어 70대 노인이 놀라 넘어졌고, 그로 인해 숨졌다는 사실은 모두 인과관계를 인정했습니다. 다만 2심 재판부는 천 씨가 넘어지기 전에 개와 약간의 거리가 있었고, 그 상황에서 어떤 방어조치라도 취할 수 있지 않았겠느냐는 정도는 감안해줘야 한다고 판단했습니다. 그래서 1심 판결에서 샤 씨의 책임을 20% 정도를 경감해줘서 28만 위안, 우리돈 5천만 원을 배상하라고 판결했습니다.\n\n이번 사건은 형사소송으로까지 번지진 않았습니다. 천 씨의 가족들이 형사 고소를 했다면 어떻게 됐을까요? 민형사 사건은 엄밀히 다른 사안입니다만, 우리나라 판례엔 반려견 관리를 소홀히 하는 바람에 사람이 개에게 물려 크게 다치게 한 사건에 유죄 선고를 한 사례가 있습니다. \n\n중국에서도 반려견은 애견인들에게 가족 이상인 거 같습니다. 점점 더 각박해지는 도시 생활 속에선 더더욱 그렇겠죠. 다만 남의 일에 신경 안 쓰는 중국인 특유의 생활태도가 남의 불편도 신경 쓰지 않는 걸로 이해되는 경우가 많습니다. 자신의 반려견이 소중할 수록, 반려견을 키우는데도 책임이 뒤따른다는 걸 중국인들이 이번 판결을 통해 한 번쯤 생각해보길 바랍니다. \n\nhttps://steemitimages.com/DQmWpisRXDF56mV3DgzzPUxb3R2ozseR48YVr2YKtwtrBcV/DQmWpisRXDF56mV3DgzzPUxb3R2ozseR48YVr2YKtwtrBcV.gif",
