He writes:\n<blockquote>A source close to the Ecuadorian Foreign Ministry and the President\u2019s office,<br> unauthorized to speak publicly,<br> has confirmed to the Intercept that Moreno is close to finalizing,<br> if he has not already finalized,<br> an agreement to hand over Assange to the UK within the next several weeks. The withdrawal of asylum and physical ejection of Assange could come as early as this week. On Friday,<br> RT\u00a0<a href=\"https:\/\/www.rt.com\/news\/433783-wikileaks-assange-ecuador-uk\/\">reported<\/a>\u00a0that Ecuador was preparing to enter into such an agreement...\n\nThe central oddity of Assange\u2019s case \u2013 that he has been\u00a0<a href=\"https:\/\/www.telegraph.co.uk\/news\/worldnews\/wikileaks\/8579350\/WikiLeaks-Julian-Assanges-excessive-and-dehumanising-house-arrest.html\">effectively imprisoned for\u00a0eight years<\/a>\u00a0despite never having been charged with,<br> let alone convicted of,<br> any crime \u2013 is virtually certain to be prolonged once Ecuador hands him over to the U.K. Even under the best-case scenario,<br> it appears highly likely that Assange will continue to be imprisoned by British authorities.\n\nThe only known criminal proceeding Assange currently faces is a\u00a0pending 2012 arrest warrant for \u201cfailure to surrender\u201d \u2013 basically a minor bail violation charge that arose when he obtained asylum from Ecuador rather than complying with bail conditions by returning to court for a hearing on his attempt to resist extradition to Sweden.\n\nThat charge\u00a0<a href=\"https:\/\/www.sentencingcouncil.org.uk\/offences\/item\/bail-failure-to-surrender\/\">carries a prison term<\/a>\u00a0of\u00a0three months and a fine,<br> though\u00a0it is possible that the time Assange has already spent in prison in the UK could be counted against that sentence. In 2010,<br> Assange was\u00a0<a href=\"https:\/\/www.nytimes.com\/2010\/12\/17\/world\/europe\/17assange.html\">imprisoned in Wandsworth Prison<\/a>,<br> kept in isolation,<br> for 10 days until he was released on bail; he was\u00a0then under house arrest for 550 days\u00a0at the home of a supporter...\n\nTHE FAR MORE IMPORTANT question that will determine Assange\u2019s future is what the U.S. Government intends to do. The Obama administration was eager to prosecute Assange and WikiLeaks for publishing hundreds of thousands of classified documents,<br> but\u00a0<a href=\"https:\/\/www.washingtonpost.com\/world\/national-security\/julian-assange-unlikely-to-face-us-charges-over-publishing-classified-documents\/2013\/11\/25\/dd27decc-55f1-11e3-8304-caf30787c0a9_story.html?utm_term=.710506f98e0c\">ultimately concluded<\/a>\u00a0that there was no way to do so without either also prosecuting newspapers such as the New York Times and the Guardian which published the same documents,<br> or create precedents that would enable the criminal prosecution of\u00a0media outlets in the future.\n\nIndeed,<br> it is technically a crime under U.S. law for anyone \u2013 including a media outlet \u2013 to publish certain types of classified information. Under U.S. law,<br> for instance,<br> it\u00a0<a>was a felony<\/a>\u00a0for the Washington Post\u2019s David Ignatius\u00a0<a href=\"https:\/\/www.washingtonpost.com\/opinions\/why-did-obama-dawdle-on-russias-hacking\/2017\/01\/12\/75f878a0-d90c-11e6-9a36-1d296534b31e_story.html?utm_term=.05839fdc78c4\">to report on the contents<\/a>\u00a0of telephone calls,<br> intercepted by the NSA,<br> between then National Security Adviser nominee Michael Flynn and Russian Ambassador\u00a0Sergey Kislyak,<br> even though such reporting was clearly in the public interest since it proved Flynn lied when he denied such contacts...\n\nBut the U.S. Justice Department has never wanted to indict and prosecute anyone for the crime of\u00a0<em>publishing\u00a0<\/em>such material,<br> contenting themselves instead to prosecuting the government sources who leak it. Their reluctance has been due to two reasons: first,<br> media outlets would argue that any attempts to criminalize the mere<em>\u00a0publication<\/em>\u00a0of\u00a0classified or stolen\u00a0documents is barred by the press freedom guarantee of the First Amendment,<br> a proposition the DOJ has never wanted to test; second,<br> no DOJ\u00a0has wanted as part of\u00a0its legacy the creation of a precedent that allows the U.S. Government to criminally prosecute journalists and media outlets for\u00a0reporting classified documents.\n\nBut the Trump administration has made clear that they have no such concerns. Quite the contrary: last April,<br> Trump\u2019s then-CIA Director Mike Pompeo,<br> now his Secretary of State,<br>\u00a0<a href=\"https:\/\/theintercept.com\/2017\/04\/14\/trumps-cia-director-pompeo-targeting-wikileaks-explicitly-threatens-speech-and-press-freedoms\/\">delivered a deranged,<br> rambling,<br> highly threatening broadside<\/a>\u00a0against WikiLeaks. Without citing any evidence,<br> Pompeo decreed that WikiLeaks is \u201ca non-state hostile intelligence service often abetted by state actors like Russia,<br>\u201d and thus declared: \u201cwe have to recognize that we can no longer allow Assange and his colleagues\u00a0<em>the latitude to use free speech values against us<\/em>.\u201d..\n<p class=\"p1\">But there seems little question that,<br> as Sessions surely knows,<br> large numbers of U.S. journalists \u2013 along with many,<br> perhaps most,<br> Democrats \u2013 would actually support the Trump DOJ in prosecuting Assange for publishing documents. After all,<br> the DNC\u00a0<a href=\"https:\/\/theintercept.com\/2018\/04\/20\/the-dncs-lawsuit-against-wikileaks-poses-a-serious-threat-to-press-freedom\/\">sued WikiLeaks in April\u00a0<em>for publishing documents<\/em><\/a>\u00a0\u2013 a serious,<br> obvious threat to press freedom \u2013\u00a0and few objected.<\/p>\n<p class=\"p1\">And it was Democratic Senators\u00a0<a href=\"https:\/\/www.wsj.com\/articles\/SB10001424052748703989004575653280626335258\">such as Dianne Feinstein<\/a>\u00a0who,<br> during the Obama years,<br> were urging the prosecution of WikiLeaks,<br> with the support of\u00a0<a href=\"https:\/\/www.politico.com\/blogs\/under-the-radar\/2010\/12\/bond-and-feinstein-urge-prosecution-of-wikileaks-julian-assange-031148\">numerous GOP Senators<\/a>. There is no doubt that,<br> after 2016,<br> support among both journalists and Democrats for imprisoning Assange for publishing documents would be higher than ever.<\/p>\n\n<\/blockquote>\nGreenwald added on <a href=\"https:\/\/twitter.com\/ggreenwald\/status\/1020674451443085314\">Twitter<\/a>: \"It should take only the tiniest amount of rationality to understand the dangers to journalists from having the DOJ prosecute Assange for publishing classified or stolen documents. From the Pentagon Papers to the Snowden reporting to daily leaks,<br> media outlets do that every day.\"\n\n<a href=\"https:\/\/www.motherjones.com\/kevin-drum\/2018\/07\/ecuador-may-be-getting-ready-to-release-julian-assange\/\">Kevin Drum<\/a> does not think there would be\u00a0 much support for prosecution among journalists or Democrats:\n<blockquote>I don\u2019t have any independent knowledge of what will happen to Assange next,<br> or whether he will indeed eventually be extradited to the United States. But I will say this. If the case brought against him is a fairly ordinary one of publishing classified material,<br> I expect,<br> contra Greenwald,<br> that virtually no Democrats and absolutely no journalists will support the government\u2019s case.\u00b9 There would,<br> unfortunately,<br> probably be a few Democratic politicians who would cheer his prosecution,<br> but even there I think (or hope,<br> anyway) that their numbers would be small. If this case goes forward,<br> I suppose it will be a good test of whose level of cynicism is currently best calibrated to the current mood of the American public.\n\n\u00b9The exceptions are likely to be nutballs like Breitbart or folks like that. Even Fox News would probably defend him against a straight-up publishing charge.\n<\/blockquote>\nI agree that serious journalists will not support prosecution,<br> but am not so sure about the Democrats. Again,<br> as Greenwald pointed out,<br> the DNC has already sued WikiLeaks for publishing documents obtained by others.
